What is Wills, Estate Planning & Probate Law?

Wills, Estate Planning and Probate law refers to the laws that cover how you structure your assets (such as your home, car and money, which is often referred to as your ‘estate’), who is responsible for ensuring your wishes are followed (called the executor of a Will) and what happens to your estate after you die.

While a written will is the way that you can decide what happens after you die, you can also put in place a power of attorney or enduring power of attorney to decide how you would like your affairs to be handled while you’re alive if you're overseas, in hospital or you become unable to make your decisions (such as you lose mental capacity).

If you don’t have a Will when you die, then it is a much more burdensome process than probate, which is called getting Letters of Administration and your estate will be distributed according to a formula set out in law, rather than how you may have wished for them to be distributed.
